General Terms and Conditions (GTC)

for Bookings and Stays at NOSY TROPICANA LODGE

1. Scope of Application

These General Terms and Conditions (GTC) apply to all bookings, reservations, and services between NOSY TROPICANA LODGE, operated by Anna and Eugen Haag, located in Ambaro, 207 Nosy Be, Madagascar (hereinafter referred to as the “Lodge”), and the guest.

By making a booking, the guest accepts these Terms and Conditions.

2. Booking and Contract Conclusion

Booking requests can be made via the website, email, telephone, WhatsApp, or other communication channels.

An accommodation contract is only concluded once the Lodge confirms the booking in writing.

Booking confirmation may be provided electronically (e.g. via email, WhatsApp, or messenger services).

The Lodge reserves the right to decline booking requests without stating reasons.

3. Prices

The prices agreed upon at the time of booking shall apply.

All prices are stated in EURO (and additionally in Malagasy Ariary, where applicable), unless otherwise specified.

Only the services expressly described are included in the price.

Additional services such as transfers, excursions, extra meals, beverages, laundry service, or special requests will be charged separately unless otherwise agreed.

Price changes and errors remain reserved to the extent permitted by law.

4. Payment Terms

The Lodge is entitled to request a deposit to secure the booking.

Unless otherwise agreed:

  • A deposit of 100% of the total booking amount is due within 7 days after issuance of the pro forma invoice.

Accepted payment methods:

  • Bank transfer

  • Cash payment (for additional services)

  • PayPal

  • Other payment methods by prior arrangement

In case of late payment, the Lodge reserves the right to cancel reservations.

5. Cancellation Policy

Cancellations must be made in writing.

Unless otherwise agreed, the following cancellation fees apply:

  • More than 30 days before arrival: free of charge

  • 15–30 days before arrival: 30% of the total amount

  • 7–14 days before arrival: 50% of the total amount

  • Less than 7 days before arrival: 100% of the total amount

In case of no-show without prior cancellation, the full booking amount will be charged.

Any deposits already paid may be offset against cancellation fees.

5.1 Special Conditions for Peak Season and Public Holidays

Separate payment and cancellation conditions apply to bookings made during peak season.

Peak season includes, in particular, periods around:

  • Christmas

  • New Year

  • Easter

  • School holidays

  • Public holidays

  • Other peak travel periods defined by the Lodge

The exact peak season periods will be communicated at the time of booking.

Unless otherwise agreed, the following conditions apply for peak season bookings:

5.1.1 Payment Terms for Peak Season and Public Holidays

A deposit of 100% of the total booking amount is required to confirm the reservation.

If payment is not made on time, the Lodge reserves the right to cancel the reservation.

5.1.2 Cancellation Policy for Peak Season and Public Holidays

The following cancellation fees apply:

  • More than 60 days before arrival: 30% of the total amount

  • 30–60 days before arrival: 50% of the total amount

  • Less than 30 days before arrival: 100% of the total amount

In case of no-show or early departure, the full booking amount remains payable.

5.1.3 Minimum Stay During Peak Season

During certain peak season periods, the Lodge may require a minimum stay (e.g. 3, 5, or 7 nights).

Guests will be informed of this before completing the booking.

6. Rebookings / Changes to Reservation

Changes to reservations are subject to availability.

There is no entitlement to rebooking.

The Lodge may accept or decline rebooking requests at its sole discretion.

Any additional costs resulting from price changes or seasonal adjustments shall be borne by the guest.

7. Check-in and Check-out

Unless otherwise agreed, the following times apply:

  • Check-in: from 2:00 PM

  • Check-out: until 11:00 AM

Earlier arrival or later departure is only possible upon prior agreement and subject to availability.

Late check-out may incur an additional daily charge.

8. Use of Accommodation

Guests are required to treat the accommodation, furniture, and inventory with care and respect.

The following are strictly prohibited:

  • Intentional damage

  • Disturbing behavior toward other guests

  • Illegal activities

  • Excessive noise

The Lodge reserves the right to terminate a guest’s stay in the event of serious violations.

In such cases, no refund will be granted.

9. Children and Minors

Minors may only stay when accompanied by a parent or legal guardian.

Parents or accompanying adults bear full responsibility for supervision.

The Lodge shall not be liable for accidents resulting from insufficient supervision.

10. Pets

Pets are not allowed.

Please note that two dogs and one cat already live on the property.

11. Damages and Liability for Compensation

Any damage caused by the guest to:

  • Buildings

  • Furniture

  • Inventory

  • Technical equipment

  • Outdoor facilities

will be charged to the guest.

Normal wear and tear is excluded.

The guest is also liable for damage caused by accompanying persons or visitors.

12. Liability of the Lodge

The Lodge shall only be liable for damages resulting from intentional misconduct or gross negligence.

Liability for slight negligence is excluded to the extent permitted by law.

In particular, the Lodge is not liable for:

  • Power outages

  • Internet outages

  • Water supply interruptions

  • Transport delays

  • Flight cancellations

  • Weather-related restrictions

  • Insects, natural, or environmental conditions typical of tropical regions

13. Valuables

The Lodge accepts no liability for loss, theft, or damage to guests’ personal belongings unless caused by proven gross negligence on the part of the Lodge.

Guests are responsible for the safe storage of their valuables.

14. Force Majeure

The Lodge shall not be liable for service disruptions or failures caused by force majeure.

This includes, in particular:

  • Cyclones

  • Floods

  • Natural disasters

  • Pandemics

  • Strikes

  • Political unrest

  • Government measures

  • War or security risks

In cases of force majeure, no claim for damages shall arise.

15. Excursions, Transfers, and Third-Party Providers

If the Lodge arranges transfers, tours, or activities, these may be provided by third-party operators.

The Lodge is not liable for services, delays, or damages caused by external providers.

Additional terms and conditions of the respective provider may apply.

16. Data Protection

Personal data is used exclusively for processing bookings, handling inquiries, and guest services.

The Lodge undertakes to treat personal data confidentially and not to disclose it to unauthorized third parties.

Data processing is carried out in accordance with applicable data protection laws.

17. Jurisdiction and Applicable Law

The laws of Madagascar shall apply to the extent permitted by law.

The place of jurisdiction shall be the registered office of the Lodge unless mandatory legal provisions state otherwise.

18. Final Provisions

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

The invalid provision shall be replaced by a legally permissible provision that most closely reflects the economic intent of the original provision.
